1. Status and marketplace contract

Kelpie is supplied by YUMA IT PTY LTD (ABN 62 684 389 839, ACN 684 389 839), trading as Yuma IT. Our registered address is 49 Phillip Ave, Watson ACT 2602, Australia. Contact us at hello@yumait.com.au or through our contact page.

If the listing uses the AWS Standard Contract for Marketplace (SCMP), SCMP controls where it conflicts with this document. Otherwise this EULA, the accepted Marketplace offer, and the Terms and conditions form the contract for that purchase.

Use this page as the Marketplace EULA URL: https://kelpie.yumait.au/eula.

2. Grant

The publisher grants the subscribing organisation a non-exclusive, non-transferable right to run the Kelpie container images for the term and quantity of the active AWS Marketplace agreement. Each agreement is identified by the Marketplace license, not by AWS account ID.

No ownership of Kelpie transfers to the subscriber. Open-source components remain governed by their licences.

3. Scope

Kelpie supports incident response, SOC case operations, investigation, evidence, approved response actions, reporting, and related security operations. It does not provide legal advice, accreditation, certification, IRAP status, or government endorsement.

Use is limited to the organisations, environments, users, capacity, and deployment model in the Marketplace agreement or other Order.

4. Customer responsibilities

  • Deploy and operate the software in your AWS account, including VPC, database, storage, identity, backups, and updates.
  • Configure identity, users, roles, integrations, and approvals correctly.
  • Ensure uploaded content and requested response actions are lawful and authorised.
  • Review generated or AI-assisted output before relying on it.
  • Maintain a valid AWS Marketplace agreement. Unsubscribed accounts must not continue to run the images.

5. Publisher responsibilities

  • Publish signed or versioned container images and deployment guidance.
  • Check Marketplace entitlement from the running tasks using AWS License Manager.
  • Provide support through hello@yumait.com.au according to the selected support tier.

The publisher does not operate the subscriber’s production environment and does not host subscriber incident evidence in a publisher SaaS tenant under this listing.

6. Marketplace billing

Purchases, taxes, invoices, refunds, and cancellations follow AWS Marketplace processes and the accepted offer, including private offers. See the Refund policy.

7. Privacy

The canonical privacy policy is the Kelpie Privacy Policy. Customer-controlled deployments keep incident, user, evidence, identity, and integration data in the subscriber’s environment unless the subscriber intentionally provides it for support.

8. Restrictions

Users must not misuse the service, attempt unauthorised access, upload malware, bypass licence or rate limits, reverse engineer Kelpie except where law expressly permits it, or use the product to violate law or third-party rights.
